What is E-ING?

E-ING is Hungary's new electronic land registry system, designed to digitize and streamline all land office procedures. This intelligent database connects various electronic registries, ensuring data accuracy, up-to-date information, and timely registrations. The system aims to enhance efficiency, reduce paperwork, and provide faster decision-making in land registry matters.

Key Changes Affecting Clients

1. Mandatory Electronic Procedures

    • Digital Submissions: All applications, authorizations, and declarations related to real estate transactions must be submitted electronically.
    • Electronic Documents: Contracts and other legal documents can still be signed on paper but will need to be converted into electronic form for submission.
    • Unified System: E-ING integrates data from various official registries to eliminate discrepancies and ensure consistency.

2. Electronic Signatures Required

    • Client Obligations: Clients must use electronic signatures to authorize legal representatives and sign certain documents.
    • Accepted Electronic Signatures:
      • eID Card (e-Személyi): An electronic signature linked to your personal identification card.
      • Trust Service Providers: Electronic signatures provided by certified providers within the EU.
      • Government Office or Consulate Authentication: In-person authentication services for those without electronic signature capabilities.
    • Authentication Backed Document Authentication (AVDH): Currently available but expected to be phased out with the introduction of Digital Citizenship (DÁP).

3. Mandatory Legal Representation

    • Legal Requirement: Legal representation is mandatory for registering or deleting any rights or legally significant facts in the land registry.
    • Qualified Representatives: Only authorized and registered lawyers who meet specific training and insurance requirements can act in the E-ING system.
    • Power of Attorney: Clients must electronically sign the power of attorney for their legal representative using an accepted electronic signature method.

4. Automatic Decision-Making

    • Faster Processing: Certain applications may be processed automatically within 24 hours during working hours.
    • Eligibility: Automatic decision-making applies to straightforward cases where all electronic validations pass.
    • Full Procedure Option: Clients can request a full procedure within 5 days if they disagree with an automatic decision.

5. Data Accuracy and Integration

    • Data Verification: E-ING verifies client data against official registries to ensure accuracy.
    • 4T Data Compliance: Personal data (name, birth details, mother's maiden name) must match exactly with registry records.
    • Foreign Clients: Special provisions are in place for clients not listed in Hungarian registries, such as foreign nationals.
